A History Lesson

I have seen multiple articles already on various websites stating “no entitlement program has ever been repealed.” I challenge that assumption and use FDR, the “New Deal”, and the conservative coalition as my case in point.
A quick look back at the years 1935 and 1936 reminds us that in that time the Supreme Court struck down 8 of FDR’s social welfare programs as being unconstitutional. This resulted in his fatal overreach. He referred to SCOTUS as “nine old men” to garner public support and thinking he had the people’s and the Congress’ backing, FDR then attempted to water down his opposition. Upset that the Court was hampering, even destroying, his successes in Congress, FDR submitted a bill to the Congress that doomed his “100 days plan to jam bills through congress” (sound familiar)? Known as court packing, FDR submitted a proposal to force mandatory retirement on any Justice over a certain age (which would have eliminated three of his opponents) and to expand the size of the Supreme Court from 9 to 12. Congress was outraged that anyone would try to control the Supreme Court like that and suddenly became much less amenable to FDR’s further attempts at legislation.
FDR didn’t have much of a choice in “court packing.” It made no difference that he had a free hand with Congress if the Supreme Court nullified and invalidated everything that the Congress passed! He was forced to play the only card he had–support in Congress–to try to reduce the Court’s ability to hamstring his New Deal legislation. In this gamble Mr. Roosevelt lost. He remained an effective president and did much to ease the Great Depression, but never again was he given such a free hand in creating law and initiating policy.
That brings me to my second point, which is that with New Deal programs that were not struck down. a small group in congress known as the conservative coalition stuck together, even in the face of overwhelming democratic majorities in both houses. By holding their ground and remaining resolved, the conservative coalition was able to shut down a large part of the “New Deal” when the US entered WWII.
If we look to our history as a guideline, we can see the parallels of our past repeating themselves today. Lucky for us, we also have a blueprint on how to defeat a whole new crop of entitlement programs. The way forward is known–we need the WILL to get it done. Passage of the so-called “health care reform” bill in the House of Representatives this past Sunday, March 21 (I won’t even address the inferred unconstitutionality of Congress doing business on the Lord’s Day. See Article. I. Section. 7. Paragraph. 2.) drove yet another stake into the heart of America. For all intents and purposes, it is the health of the United States that is in dire need of healing. In fact, the US has been on extended life-support for decades. With its condition being rendered critical, and absent major surgery, its days are numbered. The passage of this bill only serves to further weaken an already frail Constitution. In fact, this one may prove to be the fatal blow. Lady Liberty may never recover.
The decision by Congress to socialize medicine in the US ranks among the most draconian, most egregious, most horrific actions ever taken by the central government in Washington, D.C. This bill rocks the principles of liberty and constitutional government to the core. It changes fundamental foundations; it repudiates historical principle. Oh! The same flag may fly on our flagpoles, the same monuments may grace our landscape, and the same National Anthem may be sung during our public ceremonies, but it is not the same America. The Congress of the United States has now officially turned America into a socialist state.
On March 23, 2010, President Barack Obama signed the health care bill into law, and as such, this date–along with March 21–joins a list of dates that have each inflicted unconstitutional, socialistic, and sometimes even tyrannical action against the States United and have, therefore, contributed to the destruction of a free America. Thomas Jefferson’s Other Declaration

In 1798 Thomas Jefferson secretly drafted another declaration few people know about...
Most Americans know that Thomas Jefferson was the principal author of “The Declaration of Independence”, the most important of all our founding documents.
Yet few of them have even heard of another document that I would say might be the second most important declaration he ever wrote: The Kentucky Resolutions of 1798. He drafted them secretly while he was serving as vice president. It was written in response to the hated Alien and Sedition Acts which were passed under the Adams administration during an undeclared war with France.
The acts authorized the president to deport any resident alien considered dangerous to the peace and safety of the United States, to apprehend and deport resident aliens if their home countries were at war with the United States, and criminalized any speech which might defame Congress, the President, or bring either of them into contempt or disrepute. You could compare it to the Patriot Act, but really it was much worse. Either way, The Alien and Sedition Acts were probably Thomas Jefferson’s worst nightmare. [Read more →]
